PRIVACY NOTICE PURSUANT

Dear Customer,
in accordance with art. 13 of Regulation (EU) 2016/679 (hereinafter the “Regulation or GDPR”), with regard to the personal data which will enter into the possession of KONRAD TECNO SRL (hereinafter the “Controller”), we would like to inform you of the following:
1. PURPOSES OF THE PROCESSING
The Data Controller processes personal data, identification (for example, name, surname, trading name, address, phone number, email address, banking and payment references) hereinafter referred to as ‘personal data’ or also ‘data’, provided by you for performing contracts and services supplied by the Controller.
2. OBJECTIVES OF THE PROCESSING
Your personal data are processed::
A) without your express consent art. 6 letters b), e) of the GDPR, for the following service objectives:
• to perform contracts for services supplied by the Data Controller;
• to comply with pre-contractual, contractual and taxation obligations arising from the business relationship entered into with you;
• to comply with obligations demanded by the law, a regulation, an EC directive or an Official order
• to exercise the rights of the Controller, for example the right to legal defence;
B) only subject to your specific separate consent (art. 7 GDPR), for the following marketing purposes:
• to send you via email, post and/or text message and/or telephone contacts, newsletters, marketing communications and/or advertising material on products or services offered by the Controller and questionnaires on the level of satisfaction with the quality of the services supplied;
We would like to point out that if you are already our customer, we may send you marketing communications regarding the Controller’s services and products similar to those you already use, unless you withdraw your consent
(section 130 point 4 of the Italian Privacy Code).
3. PROCESSING METHODS AND PERIOD FOR WHICH DATA ARE STORED
Your personal data is processed using the means and operations stated in art. 4 no. 2) of the GDPR and more specifically:
• collection, recording, organisation, storage, consultation, adaptation, alteration, selection, extraction, comparison, use, interconnection, restriction, communication, erasure and destruction of data.
Your personal data are processed on paper as well as by electronic and/or automated means.
The Controller will process personal data for the time necessary to perform the above objectives and in any case in accordance with the applicable laws.
For the objective referred to in point 2.B data will be stored until you object to the processing in the ways provided for in point 9.
4. ACCESS TO DATA
Your data may be made accessible for the objectives stated in art. 2.A) and 2.B):
• to the Controller’s employees and collaborators in their capacities as managers and/or internal processing officers and/or system administrators;
• to third part companies or other persons (by way of example; credit agencies, professional studios, etc) who work on behalf of the Controller, in their capacities as external data processors.
An updated list of data managers and processors is kept at the Data Controller’s head office.
5. COMMUNICATION OF DATA
Without the need for express consent pursuant to art. 6 letters b) and c) of the GDPR, the Controller may communicate your data for the purposes stated in art. 2.A) to:
• agencies, professionals, companies or other organisation used by us to deal with matters of administrative, accounting and management obligations involved in running routine business activities, including for the recovery of credit;
• agencies, professionals, companies or other organisation used by us to deal with matters of administrative, accounting and management obligations involved in running routine business activities, including for the recovery of credit;
• banks, financial institutions or other entities to which the transfer of the data is necessary in order for our company to carry on its business activities and for the Controller to perform the contractual obligations undertaken towards you.
6. DISSEMINATION OF DATA
Your data will not be disseminated.
7. TRANSFER OF DATA
Your personal data is kept at the Controller’s head office and will not be sent outside the European Union.
8. PROVIDING DATA AND CONSEQUENCES OF REFUSAL TO PROVIDE DATA
Providing data for the purposes stated in art. 2.A) is obligatory.
If it is not provided, we cannot guarantee the services stated in art. 2.A).
Providing data for the purposes stated in art.2.B) is on the contrary optional. You may therefore decide not to provide all the data requested or later decide to withdraw your consent for the data already provided to be processed:
If you decide to do this, you will not be able to receive newsletters, marketing communications and advertising materials concerning the services offered by the Controller. You will however still be entitled to receive the services stated in art. 2.A).
9. RIGHTS OF THE DATA SUBJECT
You will nevertheless be able to exercise your right to access your personal data in accordance with art. 15 and subsequent provisions of the GDPR, in the ways stated in art. 12 of the GDPR. These rights may be exercised by sending a written request by email to privacy@kontec.it or by writing to the Company head office.
10. RIGHT TO MAKE A COMPLAINT TO THE SUPERVISORY AUTHORITY
If the Controller does not respond to you within the timeframe specified in the Regulation or if you consider the response to the right you exercised to be unsatisfactory, you may lodge a complaint with the supervisory authority for the protection of personal data in accordance with art. 77 of the Regulation.
